- Safe Harbor Provisions:The DMCA provides “safe harbor” protections for online service providers (OSPs) and internet service providers (ISPs). These provisions protect OSPs and ISPs from liability for copyright infringement committed by their users, provided they follow certain procedures.

– Removing or disabling access to infringing material upon receiving a valid “takedown notice” from the copyright owner.
– Designating an agent to receive such notices.
– Implementing policies for terminating accounts of repeat infringers.
- Notice and Takedown Procedure:The DMCA establishes a formal process for copyright owners to request the removal of infringing content from online platforms. If we receive a legitimate request to remove infringing content, our process involves sending a notice to the Creator, and we will promptly remove or disable access to the infringing material. The alleged infringer has the right to submit a counter-notice if they believe the material was removed by mistake or misidentification. - Safe Harbor for Caching and Hosting: The DMCA includes specific provisions for temporary storage (caching) and hosting, providing protections to service providers that offer these services as long as they meet certain conditions. We may utilise this service and will inform both the Creator and the copyright owners if we do.
- Protection for Rights Management Information:The DMCA prohibits the removal or alteration of copyright management information (e.g., metadata) that identifies the work and its copyright owner, and also prohibits the distribution of works with such information removed or altered. The DMCA is a significant piece of legislation in the realm of digital copyright law, balancing the interests of copyright holders with the practical realities of operating internet services.
